Who cleans the gutters in a Queensland rental?

The short answer

In a Queensland rental, gutter cleaning usually sits with the owner: the Residential Tenancies Authority (RTA) says that if the tenant has not done anything to block the gutters, the property manager or owner may be responsible for cleaning them. A tenant who causes a blockage may have to pay for its removal and any damage.

Gutters come up every year as the wet season gets close, and the answer turns on what caused the blockage, not on whose name is on the lease. Leaf litter, silt and seed pods that build up over time are usually treated as maintenance, and maintenance in a Queensland rental generally belongs to the owner. The tenant's side is narrower: keep the place clean, avoid causing damage, and report problems early.

What the RTA says about drains and gutters

The RTA's drains and gutters guidance is short and turns on cause. If the tenant has not done anything to block the gutters, the property manager or owner may be responsible for cleaning them. If a drainpipe blockage comes from fair wear and tear, and the RTA gives tree roots as the example, the owner is responsible for having the drainpipes cleared and kept to a working standard. If the tenant's actions caused the blockage, the tenant may be responsible for removing whatever caused it and may have to pay for the removal and any damage.

  • Leaves, silt and debris that build up from trees and weather: usually the owner's maintenance.
  • Tree roots in a drainpipe: the owner's responsibility, as fair wear and tear.
  • A blockage the tenant or their guests caused: the tenant may pay for removal and any damage.

The owner must maintain the premises and inclusions in good repair and keep them compliant with the minimum housing standards throughout the tenancy. The tenant must keep the premises clean, make sure they and their guests do not damage them, and tell the property manager or owner as soon as possible when repairs are needed.

Can the lease make the tenant clean the gutters?

Some leases carry a special term about gutters. Tenants Queensland's repairs and maintenance factsheet says any term in a tenancy agreement stating that the tenant is responsible for routine repairs and maintenance is void and unenforceable, because the owner cannot contract out of the repair obligations.

Gutter cleaning is routine maintenance, so a clause that hands the whole job to the tenant is on shaky ground. Neither side should rely on one without checking first. The RTA takes calls on 1300 366 311, and it is a cheaper conversation than a bond dispute over a gutter clause.

Why roof work usually sits with the owner

Even where a tenant could reach part of a gutter, there is a practical reason the job belongs with the owner. The Queensland Government's ladder safety advice says over 1,000 Queenslanders are hospitalised each year after falling off ladders, and that on average more than 30 Australians, mainly men, die each year after a ladder fall.

The same advice says never to use a ladder in thunderstorms, rain or wind, and not to stand above the third rung on an extension ladder. In Cairns, the months when gutters matter most are also the months when roofs are wet. Asking a tenant to climb onto a slippery roofline to save the cost of a clean is a poor trade for everyone involved.

For a tenant, the safer move is to report it. A written message to the property manager noting overflowing gutters, a sagging section or water where it should not be puts the maintenance request on record and passes the job to the person responsible for it.

Blocked gutters, overflow and who pays

A blocked gutter overflows in heavy rain, and in a Cairns downpour that water has to go somewhere. Who pays for the result follows the same logic as the cleaning itself.

Since 1 September 2024 the minimum housing standards apply to every Queensland tenancy. They require the roofing and windows to prevent water entering the premises when it rains, and the floor, walls, ceiling and roof must not be likely to collapse because of rot, a defect or significant dampness. Keeping gutters and downpipes working helps an owner meet that standard.

The RTA lists a serious roof leak, flooding or serious flood damage, and serious storm damage as emergency repairs. A tenant who sees water coming in should report it straight away. Where the tenant arranges an emergency repair under the conditions the RTA sets out, the owner must reimburse the tenant or pay the invoice within seven days.

If the tenant caused the blockage, the RTA says the tenant may have to pay for removing it and for any damage. That is why photos of the gutters at the entry condition report and at routine inspections are worth taking: they settle what was there before anyone argues about it.

Cairns timing: before the wet, after the wet

Cairns rain arrives in a block. Bureau of Meteorology climate statistics for Cairns Aero show an average of 2,025.5mm a year, with 404.8mm in January, 437.5mm in February and 422.1mm in March, each across roughly 16 rain days. September and October average only 34.1mm and 47.2mm.

That dry stretch is the window. The Queensland Government's prepare your home guidance says the best time to prepare a home is before storm, cyclone and monsoon season, and to clean gutters and downpipes so water can drain away as quickly as possible. Its cyclones and severe storms page treats November to April as storm season.

A clean in September or October clears the year's build-up while the roof is usually dry and access is easier. Where trees overhang the roof, a second check once the heaviest months have passed catches what the wet brought down before it sets hard over the dry.

Before the wet: who arranges the pre-cyclone gutter clean in a rental

In a rental, the pre-season gutter clean is usually the owner's cost and usually the property manager's job to book. The tenant's part is access and a heads-up if something looks wrong. How owners and property managers schedule it

The RTA's entry rules set the notice. For repairs or maintenance the tenant gets at least 48 hours' notice, given on an Entry notice (Form 9). Entry must be between 8am and 6pm, Monday to Saturday, and only outside those hours if the tenant agrees. No notice is needed in an emergency, or where entry is needed to protect the property from damage about to happen.
